Freddy Jones Band FREE CDs Official Sweepstakes Rules

The following rules are intended for viewing in the 50 United States and the District of Columbia by legal residents thereof only. Do not proceed in this site if you are not a legal resident of, and located in, the 50 United States or the District of Columbia at the time of entry.

This contract is sponsored by Out The Box Records, L.L.C., 3647 Woodhead Drive, Northbrook, IL 60062.

NO PURCHASE NECESSARY. Void outside the 50 United States and the District of Columbia, and where prohibited by law.

1. HOW TO ENTER. Go to http://www.otbrecords.com/FJBSweeps to enter our sweepstakes. To qualify for the sweepstakes, you will need to be a member of the Freddy Jones Band Community, or register at time of sweepstakes entry. Participant may enter only one OTBRecords.com sponsored sweepstakes per day. No credit is given to incorrectly-entered email addresses. By entering this sweepstakes, entrants give their express permission to be contacted by Sponsor by telephone, e-mail and/or postal mail, but shall have the ability to opt out of receiving such materials at any time. Entrants must provide a valid e-mail address and zip code.

Entries will be deemed to be made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Proof of being the authorized account holder may be required. The sweepstakes begins April 1, 2009 and ends December 31, 2009. By entering, entrants agree to be bound by the terms of these Official Rules. Free Internet access and e-mail accounts for on-line registration and entry may be obtained from a variety of sources, including public libraries and certain web sites such as www.yahoo.com and www.hotmail.com. Sponsor has no affiliation or relationship with any of these organizations, and makes no representations or warranty of any kind with respect to the services offered by these organizations. Sponsor is not endorsing any source of free Internet access and/or email accounts, including, without limitation, those sources identified above.

2. ELIGIBILITY. You must be a natural person, of legal age in your state of residence and a legal resident of the 50 United States or the District of Columbia for the duration of the contest. Registrants cannot be designated winners more than twice in any one consecutive six-month period. Employees of the Sponsor, its subsidiaries, affiliates, sales representatives, distributors, advertising and promotion agencies, and members of the immediate families (spouses, parents, children, and siblings and their spouses) and/or those living in the same household of each of the above are not eligible to participate. VOID WHERE PROHIBITED BY LAW.

3. RANDOM DRAWING. Winners will be selected in a random drawing from among all eligible entries received. Drawing will be conducted at Sponsor's offices by Sponsor, whose decisions are final and binding in all related matters. Odds of winning depend upon the total number of eligible entries received. Odds of winning are not improved by any purchase of Sponsor's product. Winners will be notified via e-mail. Out The Box Records will attempt to contact each monthly sweepstakes winner three times via email within one two-week period. If there is no response to any of the communications, Sponsor will select a new winner.

4. PRIZES. Twenty seven copies of the Freddy Jones Band Special Limited Edition CD Time Well Wasted will be awarded in this sweepstakes. Three winners will be chosen each month beginning April 30, 2009 and ending December 31, 2009. You must enter each month in order to qualify for that month’s drawing. Each winner will be chosen from all entries received during that respective month.

5. TERMS AND CONDITIONS. Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion. All taxes, (federal, state or local if any) associated with the acceptance and/or use of the prize are the sole responsibility of the prizewinner. Prizes are not redeemable for cash. By accepting prize, winner grants Out The Box Records and its subsidiaries, affiliates, sales representatives, distributors, advertising and promotional agencies ("Sponsor and its Agents"), the right to use and publish his/her name, state of residence and/or likeness for advertising and promotional purposes online and in print, or in any other media worldwide, in connection with the sweepstakes without limitation and without additional compensation. Noncompliance with these requirements, or the return of any prize/prize notification as undeliverable, may result in disqualification and selection of an alternate winner. Sponsor will not replace a lost or stolen prize. The names, addresses, and other information regarding contestants may be retained and used by Sponsor for customer list and market evaluation.

6. OTHER. Sponsor and its Agents are not responsible for any human errors, any computer, online, telephone or technical malfunctions or delays of any kind that occur in the transmission or processing of entries, or for inaccurate transcription of entry information or for on-line entries that are stolen, misdirected, garbled, lost or delayed for any reason. If, for any reason, the sweepstakes is not capable of being completed as planned, including, but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of Sponsor, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the sweepstakes. Sponsor also reserves the right in its sole discretion to disqualify any entrant who circumvents, violates or fails to comply with these Official Rules, who attempts to enter this Sweepstakes in any manner or through any means other than as described in these Official Rules, who attempts to disrupt this Sweepstakes, or who acts with the intent to annoy, abuse, threaten or harass any other person. By accepting prize, winner represents that he or she has complied with all rules of this sweepstakes and agrees to release Sponsor and its Agents from any and all liability, loss or damage of any kind incurred with respect to participation in the sweepstakes or to the awarding, receipt, possession, and/or use or misuse of any prize or to participation in prize-related activities and acknowledges that said parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to prize or portion thereof, including but not limited to its quality, mechanical condition, merchantability, or fitness for a particular purpose. No transfer of prizes permitted. All federal, state and/or local taxes, and other expenses associated with the acceptance and use of any prize are the sole responsibility of the winner. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CIVIL AND CRIMINAL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.

7. GENERAL RESTRICTIONS. This Sweepstakes is governed by the laws of the state of Illinois without regard to the conflicts of law provisions therein, and, by registering to play the Sweepstakes, each entrant submits to the personal jurisdiction of that state. All federal, state and local laws and regulations apply and this Sweepstakes is void where prohibited or otherwise restricted by such laws, including but not limited to jurisdictions with laws that would require registration, disclosure, filing, trust account, or posting of a bond or any other requirements that are not satisfied by these terms and conditions, including those jurisdictions which would not give effect to the choice of law and consent to jurisdiction provisions contained in the preceding sentence. The Sweepstakes is not to be used in connection with any form of gambling.
